1. INFORMATION REGARDING THE WEBSITE PRIVACY POLICY
- This section contains information regarding the methods of management of MONDOWEB S.r.l. with reference to the processing of user data of the e-commerce website https://www.talkshade.com (hereinafter “TalkShade website”).
- This policy is also provided for the purposes of Art. 13 of Legislative Decree no. 196/2003, the Personal Data Protection Code, and for the purposes of Article 13 of EU Regulation no. 2016/679 (hereinafter “GDPR”), relating to the protection, processing and dissemination of personal data of subjects who interact with the website. This information is provided only for the TalkShade website and not for other websites that may be consulted by the user via links contained therein.
- The purpose of this document is to provide information on the methods, timing and nature of the information that data controllers must provide to users when connecting to the pages of the TalkShade website, regardless of the purpose of the connection, in accordance with Italian and European legislation.
- This policy may be subject to changes due to the introduction of new regulations; therefore, users are invited to periodically check this page.
- If the user is under 16 years of age, pursuant to Art. 8, para. 1 of EU Regulation 2016/679, consent must be legitimized through authorization by parents or legal guardians.
2. DATA PROCESSING
- Data Controller
- The data controller is the natural or legal person, public authority, service or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. It is also responsible for security aspects.
- With reference to this website, the data controller is MONDOWEB S.r.l.
- Data Processor
- The data processor is the natural or legal person, public authority, service or other body that processes personal data on behalf of the data controller.
- Pursuant to Article 28 of EU Regulation no. 2016/679, the data processor for the TalkShade website is Mr. Giovanni Spina.
- Place of Data Processing
- The processing of data covered by the GDPR takes place at the company headquarters located in Formello (RM), Via degli Olmetti, 44, and is handled by technical staff of the office in charge of processing. During occasional website maintenance operations, data processing may be carried out by external parties such as the hosting service provider. The web hosting provider, which is responsible for data processing by processing data on behalf of the controller, is located within the European Economic Area and acts in compliance with European regulations.
3. COOKIES
- Cookies
- The TalkShade website uses cookies to make the user’s browsing experience easier and more intuitive: cookies are small text strings used to store some information that may concern the user, their preferences or the device used to access the Internet (computer, tablet or smartphone) and are mainly used to adapt the functioning of the website to the user’s expectations, offering a more personalized browsing experience and storing previously made choices.
- A cookie consists of a small set of data transferred to the user’s browser by a web server and can only be read by the server that made the transfer. It is not executable code and does not transmit viruses.
- Cookies do not record any personal information and any identifiable data will not be stored. If desired, it is possible to prevent the saving of some or all cookies. - Depending on their origin, cookies are distinguished between those sent to the browser directly from the site being visited and those sent to the user’s computer from other sites and not from the site being visited.

- Most third-party cookies are tracking cookies used to identify online behavior, understand interests and therefore customize advertising proposals for users.
- While browsing the TalkShade website, third-party analytical and profiling cookies may be installed. They are sent from third-party domains external to the site.

- Article 22 of EU Regulation 2016/679 and Article 122 of the Data Protection Code shall apply.
- Analytical Cookies
- Third-party analytical cookies are used to collect information about users’ browsing behavior. Data is collected anonymously in order to monitor performance and improve website usability.
- When using these types of cookies, the user must give explicit consent.
- Profiling Cookies
- Profiling cookies are aimed at creating cultural and social profiles of users and are used to send advertising messages in line with the preferences expressed by users while browsing the web.

4. DATA PROCESSED
- Methods of Data Processing
- The TalkShade website uses log files in which information collected automatically during user visits is stored. The collected information is as follows:
- Internet Protocol (IP) address;
- browser type and device parameters used to connect to the site;
- name of the Internet Service Provider (ISP);
- date and time of visit;
- referring and exit web pages;
- possibly the number of clicks.
- This information is processed in an automated manner and collected only in aggregated form to verify the correct functioning of the site and for security reasons. Such information will be processed based on the legitimate interests of the data controller.
- For security purposes (anti-spam filters, firewalls, virus detection), automatically recorded data may also include personal data such as the IP address, which could be used, in accordance with current laws, to block attempts to damage the site or harm other users, or in any case harmful or criminal activities. These data are never used to identify or profile the user, but only to protect the site and its users; such information will be processed based on the legitimate interests of the controller.
- Information that users choose to make public through the services and tools made available on the site is provided consciously and voluntarily, relieving this site of any responsibility regarding any violations of the law. It is the user’s responsibility to ensure they have permission to enter personal data of third parties or content protected by national and international regulations.
- Purpose of Data Processing
- Data collected by the TalkShade website during its operation is used for the purposes indicated above, to generate quotations or to respond to information requests.
- Data will be retained for the time strictly necessary to achieve the purposes indicated above and in any case no longer than 5 years.
- Data used for security purposes (blocking attempts to damage the site) is kept for the time strictly necessary to achieve the above-mentioned purpose.
- Data Provided by the User
- The optional, explicit and voluntary sending of emails to the addresses indicated on this site entails the subsequent acquisition of the sender’s email address, necessary to respond to requests, as well as any other personal data included in the message.

- Users can manage cookies through their browser settings. However, deleting cookies from the browser may remove the preferences set for the site.

5. USER RIGHTS
Art. 13, para. 2 of EU Regulation 2016/679 lists the rights of the user.
- The TalkShade website therefore intends to inform users of the existence of:
- the right of the data subject to request access to their personal data from the controller (Art. 15 EU Regulation), their updating (Art. 7, para. 3, letter a) of Legislative Decree 196/2003), rectification (Art. 16 EU Regulation), integration (Art. 7, para. 3, letter a) of Legislative Decree 196/2003) or restriction of processing concerning them (Art. 18 EU Regulation), or to object, for legitimate reasons, to their processing (Art. 21 EU Regulation), as well as the right to data portability (Art. 20 EU Regulation);
- the right to request erasure (Art. 17 EU Regulation), anonymization or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data was collected or subsequently processed (Art. 7, para. 3, letter b) of Legislative Decree 196/2003);
- the right to obtain confirmation that operations of updating, rectification, integration, erasure, blocking and transformation have been brought to the attention, including their content, of those to whom the data has been communicated or disseminated, except where this proves impossible or involves a manifestly disproportionate effort compared to the protected right (Art. 7, para. 3, letter c) of Legislative Decree 196/2003);
- Requests may be addressed to the data controller without formalities or, alternatively, using the form provided by the Italian Data Protection Authority, or by sending an email to: info@talkshade.com
- The TalkShade website is also equipped with an automatic system for deleting registration data by the user who intends to permanently remove them through a specific command within their control panel.
- Where processing is based on Art. 6, para. 1, letter a) – expressed consent – or on Art. 9, para. 2, letter a) – expressed consent to the use of genetic, biometric or health data, data revealing religious or philosophical beliefs, trade union membership, racial or ethnic origin, or political opinions – the user has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent given before withdrawal.
- Likewise, in the event of a violation of regulations, the user has the right to lodge a complaint with the Italian Data Protection Authority, the authority responsible for monitoring processing in Italy.

6. TRANSFER OF DATA TO NON-EU COUNTRIES
- This site may share some of the collected data with services located outside the European Union. In particular with Google, Facebook and Microsoft (LinkedIn) through social plugins and Google Analytics. The transfer is authorized and strictly regulated by Article 45, paragraph 1 of EU Regulation 2016/679, therefore no further consent is required. The above-mentioned companies guarantee their adherence to the Privacy Shield.
- Data will never be transferred to third countries that do not meet the conditions provided by Article 45 et seq. of the EU Regulation.
7. SECURITY OF PROVIDED DATA
- This site processes user data lawfully and correctly, adopting appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of data. Processing is carried out using IT and/or telematic tools, with organizational methods and logic strictly related to the indicated purposes.
- In addition to the controller, in some cases categories of staff involved in the organization of the site (administrative, commercial, marketing, legal staff, system administrators) or external subjects (such as third-party technical service providers, postal couriers, hosting providers, IT companies, communication agencies) may have access to the data.

- It may be subject to changes or updates. If these are significant changes or updates, they will be notified to users through appropriate notifications.
